An attorney can review the car accident report, examine available witness statements, investigate roadway conditions, and evaluate whether a vehicle defect or another party’s actions contributed to the collision. When a medical emergency is suspected, determining legal responsibility may require examining whether the driver experienced an unexpected medical event and whether any other contributing circumstances existed.
Motorists researching a car accident near me or a car accident near Dayton should understand that Ohio generally allows two years to file personal injury lawsuits, although exceptions may apply.
Ohio follows a modified comparative negligence system, meaning compensation may be reduced according to an injured person’s percentage of responsibility. Recovery is generally barred when that person’s share of fault exceeds 50%.
Because every accident involves different circumstances, the available evidence and applicable insurance coverage can affect whether compensation may be recovered.
